Welcome to TrailBoard ("we", "us", "our", or "TrailBoard"). These Terms of Use ("Terms") govern your access to and use of the TrailBoard web application, website, services, and software (collectively, the "Service").

By registering for an account, accessing, or using TrailBoard, you agree to be bound by these Terms and our Privacy Policy.

1. Description of Service

TrailBoard is a strategic product roadmapping software-as-a-service (SaaS) platform designed for product managers and organizations to plan, visualize, and align product initiatives using the 3-Horizon Framework (Now, Next, Later), curated portfolio collections, and strategy mapping.

2. Account Registration and Responsibilities

• Eligibility: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to register for and use TrailBoard.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activities and content submitted under your account.
• Accurate Information: You agree to provide accurate, current, and complete information during registration.

3. Subscriptions, Payments, and Merchant of Record

• Merchant of Record (Dodo Payments): All subscription plans, one-off billing, invoicing, payment processing, tax calculation (VAT/GST/Sales Tax), and payment compliance for TrailBoard are managed and processed exclusively by Dodo Payments Inc. ("Dodo Payments"), serving as our official Merchant of Record (MoR).
• Billing Terms: By purchasing a paid subscription, you authorize Dodo Payments to charge your designated payment method on a recurring billing cycle until cancelled.
• Taxes: Applicable local taxes, sales tax, or VAT will be calculated and collected by Dodo Payments at checkout.
• Cancellations & Refunds: You may cancel your subscription at any time via your account settings. Payments are non-refundable once processed except where required by mandatory local law.

4. User Content and Data Ownership

You retain full ownership and intellectual property rights over all data, roadmap items, strategies, task descriptions, collections, and materials you upload or generate within TrailBoard ("User Content"). You grant TrailBoard a non-exclusive, worldwide, royalty-free license to host, store, process, display, and reproduce your User Content solely as necessary to operate and provide the Service.

5. Acceptable Use and Restrictions

You agree not to use TrailBoard for unlawful purposes, attempt to breach or vulnerability-test our systems hosted on Render, reverse engineer the platform, or inject malicious code or automated scraping bots.

6. Service Availability and Disclaimer

TrailBoard is hosted on cloud infrastructure provided by Render. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

7. Limitation of Liability

To the maximum extent permitted by law, TrailBoard shall not be liable for any indirect, incidental, special, or consequential damages. Total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
